Mining (Designated Minerals Certification) Regulations

The Mining (Designated Minerals Certification) Regulations establish the scope and objectives of mineral traceability from extraction to export. 
This manual outlines procedures for tracking marketable mining products from extraction to export, developed from mineral substances originating from DRC's subsoil. The procedures apply to artisanal miners, traders, approved purchasing offices, processing entities, mining rights holders, customs users, and approved analysis laboratories.
Key Implementation Requirements:

  • All mining operators must publish their payments, while state services must publish receipts to ensure transparency and good governance in mining revenue management.
  • Operators must exercise reasonable due diligence to avoid contributing to conflicts or human rights violations in the DRC mining sector.
  • The system implements OECD due diligence guidelines for conflict-free mineral supply chains.

Export Procedures involve multiple steps:

  • Quality certification from OCC
  • Radioactivity evaluation certificate
  • Export verification certificate (CVE)
  • Origin certificates for different mineral types
  • Customs clearance procedures

The Traceability Process includes:

  • Production monitoring
  • Purchase operations at trading centres
  • Transport documentation
  • Transfer between provinces
  • Reception procedures
  • Customs processing

Financial Aspects:

  • Mining royalty calculations must account for transport, analysis, insurance and commercialisation costs
  • Deductible expenses must be clearly justified and verified
  • Royalty payments must be made within 30 days of sale
