(NSW) Mining Act 1992 No 29

Last updated: 8 November 2022

The Mining Act of 1992 provides an integrated framework for the regulation of prospecting and mining operations, assurance of economic return to the State from mineral resources, and environmental impact minimisation and rehabilitation requirements. Parts 3, 4, and 5 of the Act establish criteria for the permitting of exploration licences, assessment leases, and mining leases, respectively.
Concerning environmental protection, all leases must obtain consent in accordance with the Environmental Planning and Assessment Act of 1979. Part 11 of the Mining Act addresses the protection of the environment, stipulating directions regarding land rehabilitation, derelict (abandoned) mines, and environmental management planning.
